TERMS & CONDITIONS

Welcome to my website. My name is Manish Keshri, and I operate this website (manishwebtech.com) to provide information about my WordPress development, SEO, and website optimization services. By using this website or hiring my services, you are agreeing to the terms and conditions written below. If you do not agree with any part of these terms, please do not use my website or my services. These terms apply to everyone – website visitors, potential clients, and current clients alike. If you have any questions before agreeing, you can email me at keshrim121@gmail.com and I will clarify anything that is unclear.

The content on this website is for general informational purposes only. I write blog posts, service descriptions, and case studies to help business owners understand what is possible with good website development and SEO. However, every business is different. Your industry, your location, your competition, your budget, and many other factors will affect your results. What worked for one client may not work exactly the same way for you. I do my best to keep all information on this website accurate and up to date, but technology changes fast. Google updates its search algorithm several times per year. WordPress releases new versions regularly. SEO best practices evolve. Because of this, I cannot guarantee that every piece of information on this website is 100% accurate at the moment you read it. You should not rely solely on this website content to make important business decisions. For advice specific to your situation, book a consultation call with me.

When you hire me for any service – whether it is WordPress development, website redesign, monthly SEO retainer, technical SEO audit, or speed optimization – you are entering into a professional agreement with me as an independent contractor. I am not your employee. I am not a partner in your business. I am simply a freelancer and service provider whom you are paying to do specific work. You do not have the right to control how I do my work as long as I deliver what we agreed upon. I will communicate with you professionally, deliver work on time as much as reasonably possible, and be honest with you about what I can and cannot do. In return, you agree to pay me the fees we agree upon, provide me with any information or access I reasonably need to do my work (like login credentials for your website), and respond to my questions or requests for feedback in a timely manner so that I am not delayed.

Regarding payment, my fees are discussed and agreed upon before any work begins. For one-time projects like a new website, a redesign, a technical audit, or speed optimization, I typically require 50% payment upfront before I start any work, and the remaining 50% payment before I launch the website or deliver the final report. For monthly SEO retainers, I require payment at the beginning of each month before I do that month’s work. I will send you an invoice for every payment. You are responsible for paying the full amount on time. If your payment is late by more than 15 days, I have the right to pause all work until I receive the payment. If your payment is late by more than 30 days, I have the right to cancel the project entirely, and any work already completed may not be delivered to you until full payment is made. All fees are in Indian Rupees (INR) unless we specifically agree on a different currency in writing. You are responsible for any bank fees, currency conversion fees, or transaction charges associated with your payment.

I do not guarantee any specific results from my work, and this is an important point for you to understand. No honest SEO professional can guarantee that your website will rank number one on Google. No honest web developer can guarantee that your website will bring you a specific number of new customers each month. Search engines are complex systems that I do not control. Google, Bing, and other search engines can change their algorithms at any time, and those changes can affect your rankings positively or negatively. Your business results also depend on factors outside my control – like how well your team responds to leads, the quality of your products or services, your pricing, your competition, and overall market conditions. What I do promise is that I will work hard for your business. I will use my skills, experience, and best judgment to build you a high-quality website or improve your SEO. I will be honest with you about what is working and what is not. I will communicate clearly and regularly. I will not disappear after you pay me. I will treat your business as if it were my own. But specific results like “number one ranking” or “100 new customers” are never guaranteed by any ethical professional.

You own your website and all content on it. When I build you a WordPress website, I do not claim ownership of your design, your content, your images, or your domain name. You own everything. However, any code, plugins, or themes that I write specifically for your project become yours to use. If I use any third-party tools, plugins, or themes that require their own licenses (like premium WordPress plugins), you may need to purchase those licenses separately or reimburse me for them. I will tell you about any such costs upfront. You also agree that I may include a small credit link in your website footer saying “Website by Manish Keshri” or something similar, unless we specifically agree in writing that you do not want this credit. This credit link helps me get more clients, and most business owners are happy to include it. If you do not want any credit link, just tell me before we start, and I will adjust my fee accordingly.

For SEO clients, you understand that SEO is a long-term process. Most businesses do not see significant results in the first month or even the first three months. It takes time for Google to discover your website, crawl your pages, index your content, and start ranking you higher. I will work consistently every month to improve your technical foundation, optimize your content, and build your authority. But you must be patient. If you expect to rank number one on Google within 30 days, SEO is not the right service for you. I recommend committing to at least six months of SEO work to see meaningful, sustainable results. You can cancel my monthly SEO service at any time by giving me 30 days written notice via email. If you cancel, you will not receive a refund for any work already completed in the current month. I also have the right to cancel our agreement if you are consistently late on payments, if you are dishonest with me, or if working with you becomes unreasonable or abusive in any way.

For website development projects, you are responsible for providing all content – text, images, logos, videos, and any other media – by the deadline we agree upon. I can guide you on what content is needed and give you templates to make it easier, but I am not a professional content writer or photographer unless we specifically agree that I will provide those services for an additional fee. If you do not provide content on time, your website launch will be delayed, and I am not responsible for that delay. Once I finish building your website and you approve the final version, I will help you launch it and make sure everything is working properly. After launch, I provide 30 days of free support for any minor issues or bugs that arise. After those 30 days, if you need additional changes, updates, or ongoing maintenance, we can discuss a separate maintenance agreement or an hourly rate for extra work.

I am not responsible for problems caused by third parties. For example, if your hosting company has a server outage that makes your website go down, that is not my fault. If Google updates its algorithm and your rankings drop, that is not my fault. If a WordPress plugin you installed yourself (without asking me) breaks your website, that is not my fault. If your website gets hacked because you chose a cheap, insecure hosting provider or used a weak password, that is not my fault. I will do my best to help you fix any problem that arises, and I will charge you fairly for that help if the problem was not caused by my work. But I cannot take responsibility for things outside my reasonable control.

To the fullest extent allowed by Indian law, I am not liable for any indirect, incidental, special, or consequential damages arising from my work or from your use of my website. This includes loss of profits, loss of revenue, loss of customers, loss of data, or any other business interruption. My total liability to you for any claim related to my services or this website is limited to the total amount you have paid me in the previous six months. If you have paid me nothing, my liability is zero. This limitation applies regardless of whether the claim is based on contract, tort, negligence, or any other legal theory. Some jurisdictions do not allow limitation of liability for certain types of damages, so this limitation may not apply to you if you live in such a jurisdiction. But for most clients in India and most other countries, this limitation is legally enforceable.

I reserve the right to update or change these terms and conditions at any time. When I make changes, I will update the “Last Updated” date at the top of this page. If I make a significant change, I will also add a notice on my website homepage for at least 30 days. By continuing to use my website or my services after any changes, you are accepting the updated terms. It is your responsibility to check this page occasionally for updates. If you do not agree with any updated term, you should stop using my website and cancel any active services with me according to the cancellation terms described above.

If any part of these terms is found to be unenforceable or invalid by a court of law, the remaining parts of these terms will continue to be fully enforceable. The invalid part will be removed or modified just enough to make it valid while keeping its original intent as much as possible. These terms are governed by the laws of India, and any legal dispute arising from these terms or from my services shall be handled exclusively in the courts located in Mumbai, Maharashtra, India. By agreeing to these terms, you are submitting to the jurisdiction of these courts and waiving any objection based on inconvenient forum or lack of personal jurisdiction.

For any questions about these terms, or if you would like to discuss a custom agreement for a large project, you can contact me at keshrim121@gmail.com or by phone at +91 81694 44065. I am reasonable and open to negotiation on certain terms for long-term clients or larger projects. But for most small to medium projects, the terms written above are what I operate by. Thank you for reading, and I look forward to helping your business grow online.
